All orders are accepted and executed on the understanding that the Purchaser is
bound by the following conditions of sale, which shall constitute a binding contract,
except where specifically varied in writing. In the event of the customers order
containing conditions contrary to these conditions of sale they are not accepted
without written consent from the COMPANY in the following clauses means LUV-IT-FURNITURE
LTD.
NEW ORDERS Unless confirmation of your telephone order is confirmed by fax and
subsequent acknowledgement the company will not accept responsibility for any order
discrepancies.
PRICES The company reserve the right to vary the prices without notice
and to charge the purchaser the price ruling at the time of order. All prices are
exclusive of VAT which will be charged at the appropriate rate.
DESPATCH Goods are dispatched in protective wrapping and boxed and under no
circumstance will unpacking be undertaken at time of delivery by Luv-It staff.

An aborted delivery charge of £50 will be levied if agreed delivery is cancelled
on day of delivery.
It is sometimes impossible to make delivery if closing days happen to coincide
with our route/day planning.
Customers wishing to unpack/inspect goods on delivery must make prior arrangements
with the company. A surcharge for downtime will be charged at the rate of £100 per hour
(+VAT) to the nearest hour. (Refer to claims clause)
Should inspection be requested on day of delivery our driver is instructed to refuse
delivery and move on.
DELIVERY Every endeavor will be made to maintain delivery dates but no responsibility
for late delivery due to circumstances beyond our control will be accepted. In no case
shall delay be a ground for rejecting goods or terminating a contract. Deliveries are
business to business only, under no circumstances will ANY domestic deliveries be undertaken.
Deliveries are door to door only. All goods are inspected prior to dispatch.
CANCELLATION AND RETURN In no circumstances may goods correctly supplied against a firm
order be returned without the purchaser having first applied for and obtained the written
consent of the Company.
CLAIMS Claims for damage should be notified in writing to the Company within 5 working
days of receipt of goods, no liability will be accepted by the Company beyond that time frame.
Damaged goods must be returned in original packaging.

Cheques returned or represented by our bank will incur an administration charge of £50 per
cheque per representation.

IN THE EVENT OF SPLIT/PART DELIVERIES AT PURCHASERS REQUEST ALL OF THE ABOVE WILL APPLY
OWNERSHIP The ownership shall remain with the Company until such time as all sums owing
to the Company whether under contract or any other contract have been paid.
LIMITED LIABILITY Any liability, which we may incur in contract or tort (including
liability in negligence) arising out of or as a result of (a) any failure to supply or
deliver goods (b) any delay in/on delivery of goods (c) any defects in goods or service
shall be limited to the purchaser price of the goods in question. However statutory rights
are not affected.
FURNITURE CONTAINED WITHIN THE PRICE LIST AND CATALOGUE IS PRODUCED TO WITHSTAND THE
RIGOURS OF DOMESTIC USE FOR WHICH PURPOSE IT IS ENTIRELY SUITABLE. NO RESPONSIBILITY WILL
BE ACCEPTED FOR ANY COMMERCIAL LOCATION UNLESS PREVIOUSLY AGREED BY THE COMPANY.
FORCE MAJEURE These conditions of sale shall be constructed in accordance with the
laws of England and if any question, dispute or difference shall arise between the parties
in respect of their interpretation, the same shall be referred by agreement to a single
arbitrator under the provisions also being the case of reference to a single arbitrator.
We shall incur no liability for failure to perform our obligations here under due to the
existence of circumstances which we have not caused and which are beyond our control.
